APIJockey TEST END USER LICENSE AGREEMENT (EULA)

Apps made available through APIJockey.com are licensed, not sold, to you. PLEASE NOTE THAT THE TERMS OF THIS END USER LICENSE AGREEMENT SHALL GOVERN YOUR USE OF THE SOFTWARE, REGARDLESS OF ANY TERMS THAT MAY APPEAR DURING THE INSTALLATION OF THE SOFTWARE.

IMPORTANT-READ CAREFULLY: BY USING THE SOFTWARE, YOU (THE INDIVIDUAL OR LEGAL ENTITY) AGREE TO BE BOUND BY THE TERMS OF THIS END USER LICENSE AGREEMENT ("EULA"). IF YOU DO NOT AGREE TO THE TERMS OF THIS EULA, YOU MUST NOT USE THE SOFTWARE."

  1. Definitions

In this Licence, the following terms have the following meaning:

"Software" means the APIJockey TEST Application. "Software Provider" is CgSe Computergrafik und Softwareentwicklung GmbH, Fuerstenfeldruck, Germany.

  1. Scope of License: The Software Provider grants to you a nontransferable license to use the Software that you have downloaded and/or licensed. The terms of this EULA will govern any content, materials, or services accessible from or purchased within the Software as well as upgrades provided by the Software Provider that replace or supplement the original Software, unless such upgrade is accompanied by a new EULA. You MAY transfer and redistribute the Software, IF you state clearly and non-ambiguous that this Software is free of charges AND is provided by Software Provider. You MAY NOT sublicense the Software. You MAY NOT reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Software, any updates, or any part thereof (except as and only to the extent that any foregoing restriction is prohibited by applicable law or to the extent as may be permitted by the licensing terms governing use of any open-sourced components included with the Software).

  2. External Services. The Software may enable access to Software Providers' and/or third-party services and websites (collectively and individually, "External Services"). You agree to use the External Services at your sole risk. Software Provider is not responsible for examining or evaluating the content or accuracy of any third-party External Services, and shall not be liable for any such third-party External Services. Data displayed by any Licensed Application or External Service, including but not limited to financial, medical and location information, is for general informational purposes only and is not guaranteed by Software Provider or its agents. You will not use the External Services in any manner that is inconsistent with the terms of this Standard EULA or that infringes the intellectual property rights of Software Provider or any third party. You agree not to use the External Services to harass, abuse, stalk, threaten or defame any person or entity, and that Software Provider is not responsible for any such use. External Services may not be available in all languages or in your Home Country, and may not be appropriate or available for use in any particular location. To the extent you choose to use such External Services, you are solely responsible for compliance with any applicable laws. Software Provider reserves the right to change, suspend, remove, disable or impose access restrictions or limits on any External Services at any time without notice or liability to you.

  3. THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.

  4. This Agreement and the relationship between you and Software Provider shall be governed by the laws of the Federal Republic of Germany excluding its conflicts of law provisions. You and Software Provider agree to submit to the personal and exclusive jurisdiction of the courts of Munich / Bavaria / Federal Republich of Germany, to resolve any dispute or claim arising from this Agreement.
